Supreme Court: In today’s hearing of the Supreme Court, the Chief Justice raised some sharp questions on the role of the Governor regarding the political crisis in Maharashtra. After lunch, Advocate Tushar Mehta answered questions.
Everything went well for three years and suddenly the relationship broke up overnight? MLAs from Shinde group continued to enjoy ministerial posts for three years and why suddenly 34 MLAs wrote to the Governor? Governor Bhagat Singh Koshyari decided to conduct majority test based on this letter? He did this because he wanted to topple the Thackeray government. Chief Justice Dhananjaya Chandrachude during the hearing in the Supreme Court in these words MaharashtraShinde-Thaker questioned the Governor’s role in the dispute.
Questioning the role of the Governor, the Chief Justice said that if he wanted, he could have ignored the letter of the 34 MLAs, treating it as an internal issue of the Shiv Sena. They should have thought that these MLAs have not sent a single letter in three years and suddenly they are sending six letters one after the other. How does everything change overnight?
Is the Governor complicit in breaking the Shiv Sena?
The Chief Justice said, ‘The government can fall only by ordering a majority test. The Governor’s office should have taken care not to cause this. The Governor felt that there was resentment among a faction of the Shiv Sena over running the government with Aghadi. But can the Governor order a floor test on this basis alone? It means that in a way he was working to break the party.
These answers were given to a question raised on the role of the Governor
These questions raised by the Chief Justice in the pre-lunch hearing were answered by Tushar Mehta, Advocate appearing for the Governor, after the lunch. Tushar Mehta said that no question can be raised on the role of the Governor. Uddhav Thackeray did not even face the floor test. From this it is clear that they do not have majority. In such a situation it is the prerogative of the Governor to conduct a majority test. Advocate Tushar Mehta said the MLAs had clearly stated in their letter that they were withdrawing their support from the government. In such a situation, what will the Governor do if the majority test does not take place?
Tushar Mehta further said that death threats are being given to MLAs. There is evidence of this. In such a situation, the governor could not remain silent. The Governor has not done anything outside the rules. What he did, he did by exercising his privilege.
